Using Finaural Studio

These Terms govern access to and use of Finaural, Finaural Studio, the website, documentation, account features, billing, API access, and related services.

Finaural Studio is a browser-based professional media workspace for creating, collaborating on, and delivering production-ready media projects. By using the service, you agree to these Terms and to the Privacy Policy.

1. Who may use the service

You may use Finaural Studio only if you can form a binding agreement or are using it through an authorized organization, employer, school, parent, or guardian. You must provide accurate account information, keep it current, protect your credentials, and remain responsible for activity under your account, workspace, API keys, and invited project access.

2. The service

Finaural grants you a limited, non-exclusive, non-transferable right to access and use Finaural Studio in accordance with these Terms, your plan, available entitlements, and applicable law. Studio features may include projects, recording, uploads, asset management, generation, collaboration, review, export, delivery, API access, and related workflows. Some capabilities may be unavailable, gated by plan, limited by role, or subject to usage limits.

3. Plans, billing, renewals, and cancellation

Paid plans, included credits, storage, feature gates, billing periods, and prices are shown at checkout or in account settings. Unless stated otherwise at checkout, paid subscriptions renew for the selected billing period until cancelled. Cancellations take effect at the end of the current billing period unless mandatory law or a separate agreement gives you a different right. You can manage billing through account settings or the payment portal where available. Taxes may apply. Refunds are provided only where required by law, stated at checkout, or agreed separately.

4. Credits and usage limits

Credits apply only to optional model-backed asset generation and related metered workflows, not to general Studio access unless a plan states otherwise. Credits, storage, project limits, priority processing, API access, and other entitlements may differ by plan. We may block or delay actions that exceed usage limits, fail payment checks, violate policy, or create operational risk.

5. Your content and project data

You retain the rights you have in media, prompts, project files, comments, markers, recordings, generated assets, exports, and other content you upload, create, or manage in Studio. You grant Finaural a limited license to host, store, process, transmit, reproduce, adapt, preview, analyze, generate derivatives, render, export, display, and otherwise use your content as needed to provide Studio, preserve project state, support collaboration, secure the service, provide support, comply with law, and enforce these Terms. This license continues while the content is retained in your account, workspace, project, backup, package, export, delivery output, audit record, or as otherwise necessary for legal or operational reasons.

6. Generated assets and third-party rights

You are responsible for the prompts, source materials, reference files, generated assets, and outputs you create or use. You must have the rights needed for your inputs and intended use. Finaural does not guarantee that generated outputs are unique, that they do not resemble existing material, or that they are suitable for every commercial use. Commercial use can depend on your plan, the source of the material, third-party licenses, and applicable law.

7. Acceptable use

You must not use the service to violate law, infringe intellectual property or privacy rights, upload or generate unlawful or abusive content, impersonate others, misrepresent source or consent, attack or probe systems, bypass access controls, distribute malware, scrape at scale, interfere with other users, expose secrets or API keys, or use Studio in a way that creates security, safety, operational, legal, or reputational risk. You are responsible for obtaining releases, permissions, and licenses for people, performances, recordings, brands, datasets, and third-party materials used in your projects.

8. Collaboration and shared projects

Project owners and authorized roles control membership, access, comments, approvals, exports, and project operations. Shared project activity may be visible to other authorized members according to roles and settings. Local devices such as microphones, MIDI devices, cameras, screen sharing, and monitoring remain local unless you record, upload, route, or intentionally share a media session.

9. API and integrations

API keys are private credentials for trusted server-side integrations. Do not place API keys in browser code, public repositories, client scripts, prompts, exported projects, or shared files. You are responsible for integration behavior, rate limits, idempotency, webhook handling, downstream systems, and any data you transfer to third-party services.

10. Moderation, enforcement, and suspension

We may reject, restrict, remove, disable, suspend, or terminate access to content, accounts, projects, workspaces, API keys, jobs, exports, or integrations when we reasonably believe there is a violation of these Terms, law, security requirements, third-party rights, payment obligations, or operational limits. Where required by law, we will provide notice, reasons, and available appeal or review mechanisms.

11. Finaural intellectual property

Finaural and its licensors own the service, software, interfaces, documentation, brands, templates, systems, and underlying technology. Except for the limited access right granted to you, no rights are transferred. You may not copy, reverse engineer, resell, sublicense, or use Finaural technology except as allowed by these Terms, documentation, open-source licenses, or a separate written agreement.

12. Service changes and availability

Finaural Studio evolves over time. We may add, change, limit, suspend, or remove features, plans, APIs, models, storage behavior, or workflows. We aim to preserve user work where possible, but online services may experience interruptions, failures, data loss, latency, queue delays, or compatibility issues. You are responsible for maintaining appropriate exports, backups, and local copies for critical production work.

13. Privacy and data controls

Personal data is handled under the Privacy Policy. Data controls may allow you to manage usage event sharing, export account or project metadata, review asset retention, delete assets, or request account deletion. Some information may remain in backups, billing records, security logs, audit records, legal files, or shared project history where retention is required or legitimate.

14. Disclaimers

The service is provided as available and as permitted by law. We do not promise uninterrupted service, error-free operation, perfect compatibility, specific creative results, legal clearance of outputs, or that every feature will remain available. Nothing in these Terms limits rights or warranties that cannot be limited under mandatory law.

15. Liability

Nothing in these Terms excludes or limits liability for intent, gross negligence, death or personal injury, fraud, mandatory product liability, or other liability that cannot be excluded by law. For ordinary negligence, Finaural is liable only for breach of material contractual obligations and only for foreseeable typical damages, unless mandatory law provides otherwise.

16. Termination

You may stop using the service at any time and may cancel paid plans as described in your account or billing flow. We may suspend or terminate access if you breach these Terms, fail to pay, create risk, or use the service unlawfully. Termination does not affect accrued fees, legal obligations, licenses needed to complete existing workflows or preserve records, or provisions that by their nature should survive.

17. Governing law and disputes

These Terms are governed by the laws of Germany, excluding conflict-of-law rules, unless mandatory consumer protection law gives you additional rights. If you are a consumer, statutory venue rules apply. If you act as a business, the courts with jurisdiction for Finaural’s registered seat have jurisdiction where legally permitted.

18. Changes to these Terms

We may update these Terms when the service, law, plans, or operating model changes. Material changes will be communicated through an appropriate product, website, account, or email notice where required. If you do not agree to updated Terms, you must stop using the service and cancel paid plans before the updated Terms apply.
